If a lien is put on a home during a divorce and the home gets foreclosed on, who pays the lien.?
When I divorced my ex husband I put a lien on the home for my half of the equity I was to receive. The home went into forelosure and the lien was never paid. Who will be responsible for the lien or will it go away not that he no longer owns the home? ... (Asked by Dean H)

Usually, the mortgage is paid first, taxes paid second, leins paid third. If the house was jointly owned by the two of you, depending on the laws of your state, you could be partially responsible for paying your own lein!! so . . .half of nothing is still nothing. Sorry....(Answered by mbrcatz17)

Before a property can legally be foreclosed on it must have a pubic notice. Those notices are in the county newspapers of those counties that the properties are located in. My recommendation to you would have an approval letter or a letter of guarantee from the bank before you go to the courthouse to bid on one. You could also make an offer to the current owner that will be listed in the notice. Good Luck...(Answered by mark)

on the newspaper. classified ads. banks usually publish the list for public bidding. it is cheaper but i guess you only have to pay the remaining balance of the previews owner plus the taxes that incurred. i dont know....(Answered by arthurmljr)

First let me say I am so sorry for your circumstances. Now, let me explain what is happening so that you wil understand. The foreclosure eliminated your interest in the home and removed your name from the title to the property. You are no longer the owner so you may not be a seller on the property. What the others have said are right, if someone wasn't paying their mortgage, they probably weren't taking very good care of it, either. My husband and I have bought a home that was in foreclosure. Try this website: http://www.hud.gov/homes/index.cfm Choose your home state, and it'll show you all HUD repos in your area. You are NOT expected to pay cash. And, loans are available - even ones which help you fix the home up. BUT, (there's always a catch) you have to have decent credit. HUD is more lenient that some lenders, but they never loan to anyone with bad credit! The HUD page also offers to match you up with a Realtor in your area, who handles repos, and will "walk" you thru the process.
